Child Support
Child support in New Jersey is established by a formula and is related to child custody. For example, if a child spends more than 28 percent of the time in the custody of the non-custodial parent, a separate formula is used to calculate child support. In all cases, it is important to consider all assets and income in the child support formula or the calculations won't be correct. We know how to ensure the child support payment you are making or receiving is appropriate to your situation.
Child Custody and Visitation
We can also help you negotiate a child custody arrangement that makes sense for you and your children. In most cases parents share joint legal custody, meaning they share in decision making on important issues such as those involving educational issues, medical care, and religion.
Physical custody, where the children live, can take many different forms. When one parent has primary physical custody the other parent normally is granted visitation rights. He or she may have custody of the children one night during the week and every other weekend. Parents may also split weeks, with the children living with one parent every other week.
In cases in which one parent's domestic violence, drug abuse, sexual molestation, or other issues may endanger the child's safety and well being, we can petition the court to award sole custody to the other parent or to a grandparent or other relative.
Modification of Court Orders
Have you experienced a substantial change of circumstances since your child custody, visitation, and support agreements were made? We can modify court orders to reflect changes such as the loss of a job, remarriage, or an increase in income.
Planning to move away from the area where your children live? Please contact our Jersey City child custody lawyers first to discuss how parental relocation affects custody and visitation rights.
